Gable Tostee is suing the state, claiming he was assaulted by two police officers at a Surfers Paradise corner shop.
News Corp has got its hand on documents filed in the District Court, that allege Tostee suffered jaw, wrist, neck and thumb injuries when he was punched, knocked to the ground and pepper sprayed by officers in January 2014.
He was arrested and taken to the watch house for five hours after the early-morning incident at the Lucky 7 convenience store on Ferny ave, before being charged with being public nuisance and obstructing police, but those charges were later dropped due to a lack of evidence.
Tostee is now suing for $300,000 in damages claiming assault and battery, false imprisonment and deprivation of liberty, also saying he suffered humiliation and distress while the incident was unfolding.
It all took place about seven months before Warriena Wright fell to her death from his Surfers Paradise apartment, for which Tostee was last year acquitted of any wrongdoing.
